1. Acceptance of Terms
By accessing our website (https://beautybutlerthailand.com/), submitting an inquiry, booking a consultation, or using any of our services, you agree to these Terms and Conditions. If you do not agree to these Terms, please discontinue use of our website and services.
2. Definitions
In these Terms and Conditions, unless the context otherwise requires:
"Company" means Beauty Butler Co., Ltd., a company incorporated under the laws of Thailand.
"Patient" means any individual who contacts the Company, requests information, books a consultation, seeks coordination services, or receives services from the Company.
"Medical Provider" means any independent hospital, clinic, surgeon, dentist, physician, healthcare professional, or healthcare institution selected by the Patient.
"Medical Services" means any consultation, diagnosis, treatment, surgery, dental procedure, cosmetic procedure, medical procedure, healthcare service, or related treatment provided by a Medical Provider.
"Agency Services" means the coordination, communication, scheduling, travel assistance, administrative support, and facilitation services provided by the Company acting solely as agent for the Patient.
"Medical Fees" means any fees, charges, deposits, hospital expenses, surgeon fees, clinic fees, or other amounts payable to a Medical Provider in connection with Medical Services.
"Commission" means the service fee payable to the Company for its Agency Services and is separate from any Medical Fees payable to a Medical Provider.
3. Our Services
The Company provides Agency Services and acts solely as an independent coordinator and agent appointed by the Patient.
The Patient authorizes the Company to communicate and coordinate with Medical Providers on the Patient's behalf, including arranging consultations, scheduling appointments, facilitating administrative matters, and coordinating travel-related arrangements.
The Company does not provide Medical Services and is not a healthcare provider.
The Company does not employ surgeons, physicians, or dentists to provide Medical Services.
The Company may employ nurses solely for patient assistance, care coordination, administrative support, and other non-medical functions. Such nurses do not independently diagnose medical conditions, prescribe treatment, perform medical procedures, or exercise independent clinical judgment. Any clinical assistance provided by such nurses, if any, shall be performed solely under the supervision and direction of the attending physician or the relevant Medical Provider. Any such assistance shall not be construed as the provision of Medical Services by the Company.
The Company does not prescribe treatment, provide medical advice, diagnose medical conditions, or make medical decisions on behalf of any Patient.
All Medical Services are provided directly by independent Medical Providers selected by the Patient. The Patient acknowledges that the final selection of any Medical Provider shall be made solely by the Patient.
The Medical Services agreement is entered into solely between the Patient and the relevant Medical Provider.
The Company is not a party to any Medical Services agreement and shall not be deemed the provider, seller, or supplier of Medical Services.
Any appointment, reservation, communication, or arrangement made by the Company is made solely in its capacity as agent acting on behalf of the Patient.
4. Agency Relationship
The Patient hereby appoints the Company as a non-exclusive agent solely for the purpose of providing Agency Services.
The authority granted to the Company is limited to administrative coordination and communication with Medical Providers.
Nothing in these Terms shall create any partnership, joint venture, employment relationship, or principal-to-principal relationship between the Company and any Medical Provider.
The Company acts independently and does not control the medical judgment, diagnosis, treatment recommendations, or professional conduct of any Medical Provider.
The Company does not recommend, endorse, warrant, or guarantee the quality, suitability, competence, licensing status, or medical outcome of any Medical Provider.
5. Payment Collection and Handling of Funds
Depending on the arrangement selected by the Patient and the Medical Provider, Medical Fees may either be paid directly to the Medical Provider or collected by the Company solely as collection agent for the Medical Provider.
Where the Company receives Medical Fees, the Company receives such amounts solely in its capacity as collection agent and intermediary.
Ownership of all Medical Fees remains with the relevant Medical Provider and such amounts shall not be considered consideration payable to the Company for Agency Services.
The Company has no beneficial ownership interest in any Medical Fees collected on behalf of a Medical Provider.
The Company shall transfer such Medical Fees to the relevant Medical Provider in accordance with the applicable arrangement.
Any Commission payable to the Company shall be separate from and in addition to any Medical Fees payable to a Medical Provider.
Where Medical Fees are paid directly to a Medical Provider, all refund requests relating to Medical Fees shall be governed solely by the policies of the relevant Medical Provider.
The Company shall not be liable for any refund decisions made by an independent Medical Provider.
6. Commission and Service Fees
The Patient acknowledges that the Company may charge a Commission for Agency Services provided to the Patient.
The Commission constitutes compensation solely for Agency Services and is separate from any Medical Fees charged by a Medical Provider.
Payment of Commission to the Company does not constitute payment for Medical Services.
Any Medical Fees remain payable separately to the relevant Medical Provider unless otherwise specified.
7. Medical Disclaimer and Risks
All surgical and cosmetic procedures carry inherent risks. The information provided on our website or during consultations is for general informational purposes only and should not be considered medical advice.
Patients are encouraged to seek independent medical advice or obtain a second opinion from a qualified healthcare practitioner before proceeding with any surgical or invasive procedure.
All medical decisions, diagnoses, treatment recommendations, and surgical procedures are the sole responsibility of the attending surgeon and medical provider.
Individual outcomes vary depending on factors such as personal health, adherence to medical instructions, healing response, and other individual circumstances. The Company does not guarantee specific results.
Patients are responsible for following all pre operation and post operation medical instructions provided by their treating surgeon or medical provider.
8. Cancellation and Amendment Policy
8.1 Deposit Policy
Deposits paid in connection with Medical Services may be subject to the refund and cancellation policies of the relevant Medical Provider.
By making a deposit or payment, the patient confirms that they understand and accept the non refundable nature of the deposit as described in these Terms.
8.2 Medical Ineligibility
A refund may be considered only if the patient is determined to be medically ineligible for the procedure after completing the required pre operation medical tests conducted by the attending surgeon or hospital.
Subject to the applicable refund policy of the relevant Medical Provider, the deposit may be refunded minus the cost of the pre operative tests and any administrative or third party costs already incurred.
8.3 Accurate Medical Disclosure
Refund eligibility in cases of medical ineligibility applies only if the patient has provided complete and accurate medical information during the consultation and screening process.
If a relevant medical condition, medication, previous surgery, or other health related information was withheld or inaccurately disclosed when requested, the deposit will remain non refundable.
8.4 Patient Cancellation
If the patient chooses to cancel the procedure for personal reasons, including changes of plans, travel disruptions, scheduling conflicts, or other non medical reasons, deposits remain non refundable.
8.5 Travel Disruptions
For travel disruptions due to government imposed restrictions or similar circumstances, rescheduling may be allowed subject to availability and an administrative fee.
Patients are strongly advised to obtain travel insurance that covers unexpected cancellations, medical complications, or other travel related risks.
8.6 Medical Postponement
If the attending surgeon determines that a procedure should be postponed for medical safety reasons, the procedure may be rescheduled subject to availability and additional costs where applicable.
9. Liability and Indemnification
The Patient acknowledges that the Company provides coordination and facilitation services only. The Company's responsibility is limited to Agency Services and administrative coordination and does not extend to the provision of Medical Services.
To the fullest extent permitted by law, the Company shall not be responsible or liable for any medical outcomes, complications, injuries, dissatisfaction with results, or other consequences arising from medical treatment performed by independent healthcare providers.
Patients acknowledge that all surgical procedures involve risks, including but not limited to complications, infection, scarring, anesthesia related risks, delayed healing, and unsatisfactory cosmetic outcomes.
The Company makes no warranties or representations regarding the outcomes of any medical or dental procedures arranged through our services.
To the fullest extent permitted by law, the Company disclaims liability for any direct, indirect, incidental, or consequential damages arising from the use of our website or services.
You agree to indemnify and hold harmless the Company, its directors, employees, and representatives from any claims, damages, liabilities, or expenses arising from your breach of these Terms or misuse of our services.
10. International Travel Responsibility
Patients traveling internationally for medical procedures acknowledge that they are responsible for ensuring they are medically fit to travel and for complying with visa requirements, travel regulations, and health related entry requirements.
The Company is not responsible for travel disruptions, visa issues, airline cancellations, or other travel related circumstances outside our control.
11. Aftercare and Follow Up Treatment
Patients acknowledge that recovery and healing vary between individuals and may require additional medical care.
Unless otherwise agreed, patients are responsible for arranging follow up care after returning to their home country.
If complications arise that require additional treatment, the associated medical, travel, and accommodation costs may be the responsibility of the patient unless otherwise agreed with the treating provider.
12. Intellectual Property
All content on this website, including text, graphics, logos, images, and other materials, is owned by or licensed to the Company.
You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.
13. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Thailand.
Any dispute arising from or relating to the use of our website or services shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.
14. No Medical Outcome Guarantee
The Patient acknowledges that no representation, statement, advertisement, marketing material, website content, social media content, or communication shall constitute a guarantee of any medical outcome unless expressly agreed in writing by the relevant Medical Provider.
The Patient acknowledges that they have not relied solely upon any advertisement, marketing material, website content, social media content, statement, or representation made by the Company when deciding to obtain Medical Services.
15. Changes to Terms
We may update these Terms and Conditions from time to time. Changes become effective once the revised version is published on our website.
Your continued use of our services after any changes indicates your acceptance of the updated Terms.
